1. Acceptance of Terms

By accessing or using Blue Ocean AI, you confirm that you are at least 18 years old (or the age of majority in your jurisdiction) and agree to comply with these Terms, our Privacy Policy, and all applicable laws and regulations. If you do not agree, you must discontinue use immediately.

2. Service Description

Blue Ocean AI provides AI-assisted content creation, image design, video generation, and social media management tools. We facilitate integration with third-party platforms including Meta (Facebook and Instagram) via their official Graph API. Our service enables users to:

• Generate marketing content using artificial intelligence
• Design images and create video content automatically
• Publish content to connected Facebook Pages and Instagram accounts
• Analyze post performance and engagement metrics
• Schedule content for optimal engagement times

3. User Responsibilities

• You are solely responsible for reviewing and approving all content generated and posted through our platform before it is published.
• You must comply with Meta's Community Standards, Platform Terms, and all applicable platform policies when using our automation tools.
• You must not use the tool to generate spam, misleading information, hate speech, or any content that violates applicable laws.
• You are responsible for maintaining the confidentiality of your account credentials.
• You must provide accurate and truthful information when creating your account.

4. AI-Generated Content

While our AI strives for high quality and relevance, Blue Ocean AI does not guarantee the accuracy, legality, or suitability of AI-generated content for any particular purpose. Users must:

• Review all AI-generated content before publishing to social platforms.
• Ensure content complies with advertising regulations and intellectual property laws in their jurisdiction.
• Accept responsibility for any content published through the platform.

5. Platform Permissions

To provide its core functionality, Blue Ocean AI requires specific permissions to access and manage your Facebook Pages and Instagram accounts. By granting these permissions, you authorize our tool to:

• Read and list your connected Facebook Pages
• Publish content on your behalf to selected pages and accounts
• Read engagement data to optimize content performance
• Manage business assets linked to your Meta Business account

You may revoke these permissions at any time through your Facebook Settings → Apps and Websites.

6. Account Termination

We reserve the right to suspend or terminate your account, with or without notice, if:

• You violate these Terms of Service
• You engage in fraudulent, abusive, or illegal activities
• You use the service to distribute spam or harmful content
• Your account is flagged by Meta for policy violations

You may also voluntarily close your account at any time by contacting us at support@bluescale.media. Upon termination, your data will be handled in accordance with our Privacy Policy and deleted within 30 days.

7. Intellectual Property

• Your Content: You retain ownership of all content you create or generate using our platform. By using our service, you grant us a limited, non-exclusive license to process your content solely for the purpose of providing the service.
• Our Platform: The Blue Ocean AI platform, including its design, code, AI models, and branding, is the intellectual property of Blue Ocean Marketing Agency, LLC and is protected by applicable copyright and trademark laws.

8. Limitation of Liability

To the maximum extent permitted by law:

• Blue Ocean AI is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind.
• We are not liable for any indirect, incidental, special, or consequential damages arising from your use of the service.
• Our total liability shall not exceed the amount you paid for the service in the 12 months preceding the claim.
• We are not responsible for service interruptions caused by third-party providers (Meta, OpenAI, cloud infrastructure).

9. Third-Party Services

Our service depends on third-party APIs and platforms including Meta Platforms, Inc. and OpenAI. We are not liable for any changes, outages, or restrictions imposed by these third-party providers. Your use of these third-party services is also subject to their respective terms of service and privacy policies.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Wyoming, United States of America, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved in the courts of Laramie County, Wyoming.

11. Changes to Terms

We may update these Terms from time to time. When we make material changes, we will notify users via email or a prominent notice on our website at least 30 days before the changes take effect. Your continued use of the service after the effective date constitutes acceptance of the updated Terms.
