These Terms of Service ("Terms") govern your use of Blue Ocean AI, operated by Blue Ocean Marketing Agency, LLC ("we," "our," us"). By accessing or using our service, you agree to be bound by these Terms.

1. Acceptance of Terms

By accessing or using Blue Ocean AI, you confirm that you are at least 18 years old (or the age of majority in your jurisdiction) and agree to comply with these Terms, our Privacy Policy, and all applicable laws and regulations. If you do not agree, you must discontinue use immediately.

2. Service Description

Blue Ocean AI provides AI-assisted content creation, image design, video generation, and social media management tools. We facilitate integration with third-party platforms including Meta (Facebook and Instagram) via their official Graph API. Our service enables users to:

  • Generate marketing content using artificial intelligence.
  • Design images and create video content automatically.
  • Publish content to connected Facebook Pages and Instagram accounts.
  • Analyze post performance and engagement metrics.
  • Schedule content for optimal engagement times.

3. User Responsibilities

  • You are solely responsible for reviewing and approving all content generated and posted through our platform before it is published.
  • You must comply with Meta's Community Standards, Platform Terms, and all applicable platform policies.
  • You must not use the tool to generate spam, misleading information, or hate speech.
  • You are responsible for maintaining the confidentiality of your account credentials.
  • You must provide accurate and truthful information when creating your account.

4. AI-Generated Content & Responsibility

Our platform utilizes advanced generative AI to assist your marketing. By using these tools, you acknowledge:

  • Final Review Mandate: You are the "publisher of record." You MUST review, edit, and approve all AI-generated text, images, and videos before publication.
  • Non-Infringement: You represent that your prompts and the resulting content do not infringe on the intellectual property rights of any third party.
  • AI Hallucinations: AI may occasionally produce inaccurate or biased information. We do not warrant the factual accuracy of AI-generated content.
  • Compliance with Brand Guidelines: You are responsible for ensuring AI-generated content aligns with your specific brand safety and legal requirements.

5. Acceptable Use Policy (AUP)

To maintain the integrity of our platform and Meta's ecosystem, you agree NOT to use Blue Ocean AI for:

  • Deceptive Content: Generating deepfakes, misleading political advertisements, or "fake news."
  • Spam & Manipulation: Automating mass-messages, "engagement bait," or artificial inflation of likes/comments.
  • Harassment: Creating content that promotes hate speech, discrimination, or targeted harassment.
  • Illegal Services: Promoting regulated goods (e.g., weapons, gambling, prescription drugs) without proper licenses and platform-specific approvals.

6. Platform Permissions & Meta Compliance

By connecting your Meta accounts, you explicitly authorize Blue Ocean AI to act as your technical service provider. This authorization is governed by the Meta Platform Terms:

  • Scope of Access: We access only the permissions you grant. You can audit these at any time via Facebook's "Apps and Websites" menu.
  • Token Security: Your access tokens are encrypted and used only for the purpose of executing your scheduled posts and fetching your insights.
  • Immediate Revocation: You have the right to revoke all permissions and request an immediate "Data Wipe" of your platform history via our Compliance Center.

7. Account Termination & Enforcement

We reserve the right to suspend or terminate access immediately, without prior notice, if:

  • You violate these Terms or our AUP.
  • Your behavior triggers Meta's automated "Inauthentic Behavior" or "Spam" detection systems.
  • You attempt to reverse-engineer our AI models or bypass platform rate limits.
  • Your account is flagged by Meta as part of an official platform enforcement action.

7. Intellectual Property

  • Your Content: You retain ownership of all content you create or generate. You grant us a limited license to process your content solely for providing the service.
  • Our Platform: The Blue Ocean AI platform, including its design, code, AI models, and branding, is the intellectual property of Blue Ocean Marketing Agency, LLC.

8. Limitation of Liability

To the maximum extent permitted by law:

  • Blue Ocean AI is provided on an "AS IS" basis without warranties of any kind.
  • We are not liable for any indirect, incidental, or consequential damages.
  • Our total liability shall not exceed the amount you paid for the service in the 12 months preceding the claim.
  • We are not responsible for interruptions caused by third-party providers.

9. Third-Party Services

Our service depends on third-party APIs including Meta and OpenAI. We are not liable for changes or outages imposed by these providers. Use is subject to their respective terms.

10. Governing Law

These Terms shall be governed by the laws of the State of Wyoming, USA. Any disputes shall be resolved in the courts of Laramie County, Wyoming.

11. Changes to Terms

We may update these Terms. For material changes, we will notify users at least 30 days before they take effect. Continued use constitutes acceptance.
